Objective

Some countries may require a Certificate of Free Sale when receiving a product. The certificate of free sale is evidence that goods are legally sold or distributed in the open market, freely without restriction, and approved by the regulatory authorities in the country of origin (United States).

Overview

Global NY is providing a Certificate of Free Sale to New York State companies, who are not able to obtain this document through their local Chamber of Commerce or though their industry association.

  • Companies in the food or cosmetics industry should contact the U.S. Food and Drug Administration.
  • Companies subject to inspection by the New York Department of Agriculture and Markets should contact the Food Safety Division
  • Companies in the dairy industry should contact the New York or United States Department of Agriculture.
  • Companies located in the New York City region should contact the Brooklyn Chamber of Commerce, the Manhattan Chamber of Commerce, or the Greater New York Chamber of Commerce.
  • Companies located in the Long Island region should contact the Farmingdale Chamber of Commerce.

Eligibility

A New York State Company must meet the following criteria before submitting an application:

  • Headquarter in New York State
  • Available for an in-person site visit
  • Does not have Certificate of Free Sale from another organization
  • Operates in New York State to manufacture or assemble a product that consists of at least 51% New York State content

Use the chart below to determine your New York State content

- aggregate value of contributed by non-NY or foreign sources  
Manufacturing costs (payment to foreign contract manufacturer) -$25
Value of all foreign-supplied parts/inputs/materials -$20
Foreign administrative costs -$2
Foreign transportation and logistics costs (up to a factory door) -$2
Licenses, royalties, and fees paid for foreign intellectual property -$0
= NYS Content  $51

Evaluation Process

Once an application is submitted, and a company is determined to be eligible, a Global NY staff member will provide you with a Certificate of Free Sale within 30-45 business days.
