Grant funding is available through the Electric Generation Facility Cessation Mitigation Program for eligible local government entities demonstrating qualifying property tax reductions and/or payments in lieu of taxes owed by an electric generation facility subject to their taxing authority.

Overview

The Electric Generation Facility Cessation Mitigation Program was created to provide grant assistance to support local government entities, including counties, towns, cities, villages, school districts and special districts, impacted by reductions in the tax liability and/or payments in lieu of taxes (Tax Loss) owed by an electric generation facility subject to their taxing authority. 

The Tax Loss must be 20% or more and a direct result of an electric generation facility ceasing operation within its jurisdiction. Empire State Development, in consultation with the New York State Energy Research and Development Authority and the Department of Public Service, is administering the program.

The fiscal year 2016–17 New York State budget appropriated $30 million for the program.

Eligibility

Eligibility

  • Local government entities (counties, towns, cities, villages, school districts, and special districts) may apply if they realize a “qualifying event."

A qualifying event occurs if:

  • On or after June 25, 2015, an electric generation facility within the applicant’s jurisdiction has ceased operations and become ineligible to participate in the markets administered by the New York Independent System Operator, Inc.
    AND
  • Such a cessation has caused a 20% or greater reduction in real property tax collections and/or Payments in Lieu of Taxes (PILOTs) owed by a facility.

How to Apply

  • Program applications will be accepted continuously and reviewed on a first-come, first-served basis
  • The program will end on July 1, 2025, or such earlier date as funding is expended
